DWI implied consent case files, 1978-1982.

Mainly records documenting the case of Milo Edward Heddan, et. al. v. Kenneth Dirkswager/John P. Sopsic (both Commissioners of Public Safety), et. al. before the Ramsey County District Court and Minnesota Supreme Court (1982-1983). The case considered the constitutionality of Minnesota's implied consent law, under which the Commissioner of Public Safety may revoke driving privileges from persons for alcohol related offenses. The term "implied consent" derives from the concept that all licensed drivers had implied consent, as a condition of licensure, to submit to an alchohol concentration test under certain circumstances. Refusal or test failure results in license revocation at the time of the stop or arrest. The plaintiffs in Heddan, et. al., in three separate incidents, had their licenses revoked for failing Breathalyzer tests. They argued the implied consent law was unconstitutional because it allows for license revocation without due process of law.
